The respondent No.2 lodged the FIR alleging that, he subscribed to the membership to the NTI Housing Cooperative Society for allotment of site, and in all, he paid a sum of Rs.1,65,00,000/- for allotment of site from the Society. The accused No.1 is the Civil Contractor executing work for the society. After receiving a sum of Rs.8 lakh, the society enrolled him as a member, allotted the site in No.898, and he showed the readiness for executing the sale deed, and the accused No.1 misled him stating that, there is a dispute pending with regard to the subject site before the Hon'ble Supreme Court, and prevented him from getting the sale deed registered in his favour. It is further alleged that, the accused No.1, with an intention to cheat him, colluded with the then President and the Secretary along with other members of the Managing Committee, and executed the registered sale deed in respect of the subject site in favour of Sri Rame Gowda. It is alleged that, the accused No.2 has agreed to allot an alternate site, and having promised, he abused him in filthy language. The registration of FIR is impugned in this petition.
