Learned High Court Government Pleader is directed to take notice for respondent No.1.

The petitioner is before this Court calling in question proceedings in CC No.1142 of 2021 on the file of II Additional Civil Judge and JMFC, Putturu, Dakshina Kannada registered for the offences punishable under Sections 341, 323, 506, 143 read with Section 149 of Indian Penal Code.

Heard Sri Sagar N., learned counsel appearing for the petitioner and the learned High Court Government Pleader for the respondent-State.

An incident of quarrel happens on 01^st October, 2021 and a complaint is registered by one G. Ismail, Vice-President of the Masjid before which the said incident happens, which becomes a Crime in Crime No.81 of 2021 which is registered by

the father of the petitioner. On 02^nd October, 2021, the next day, based upon the said incident, another crime comes to be registered in Crime No.82 of 2021. The petitioner is accused No.6 in the said crime. The police, after investigation, have filed charge sheet in both the crimes, i.e. Crime No.81 of 2021 and 82 of 2021. Both the charge sheets are for offences which are identical as quoted hereinabove.

The petitioner-accused No.6, claiming that he is in no way concerned with the incident has knocked at the door of this Court seeking quashment of the entire proceedings against him, in particular, in CC No.1142 of 2021. The learned counsel appearing for the petitioner contend that the petitioner has nothing to do with the incident that had happened on 01^st October, 2021. The crime is registered against the petitioner solely to take revenge or to wreck vengeance for the reason that the fact of the petitioner has registered a Crime in Crime No.81 of 2021.

Learned High Court Government Pleader seeks to place reliance upon both the charge sheets so filed by Police in

the aforesaid crimes and contend that it is a case and counter case, and therefore, interference is called for.

I have given my anxious consideration to the submission made by the respective learned counsel and perused material on record.

One solitary incident that happens at 2.00 pm on 01^st October, 2021, results in registration of two crimes, one in Crime No.81 of 2021 by the father of the petitioner; and the other in Crime No.82 of 2021 registered by several others in which, the petitioner along with others, is an accused. Police, after investigation, have filed the charge sheet in the crime so registered by the father of the petitioner. The summary of the charge sheet in Crime No.81 of 2021 reads as under:

Therefore, the submission of the learned counsel that

the petitioner has nothing to do with the offence so alleged and was not present at the scene of crime on 01^st October, 2021, is a matter of trial. It is for the petitioner to come out clean, as it is one of a case and a counter case where proceedings are on against all the accused in both the crimes. For the aforesaid reasons, finding no merit, petition stands rejected.
