The petitioner is before this Court calling in question investigation / proceedings in Crime No.2/2022, pending before the Principal District and Sessions Judge and Special Court, Chamarajanagar, for the offences under Sections 13(1)(b) r/w. 13(2) of the Prevention of Corruption Act, 1988.

Sri C.H.Jadhav, learned senior counsel appearing for the petitioner submits that he would restrict his submission only to a direction to the respondent to consider the representation submitted by the petitioner in clarification to the assets and liabilities.

Sri B.B.Patil, learned Special Counsel appearing for the respondent has filed the statement of objections. The respondent admit that if the petitioner submits a representation, it would be considered in accordance with law.

“12. It is further submitted that the investigation is on going and the respondent most respectfully submitted that if the petitioner were to make a representation providing clarifications as regards his income/expenditure the same shall be considered in accordance with law.”

In the light of the submissions of the learned senior counsel for the petitioner and the learned special counsel for the respondent, I deem it appropriate to dispose of the petition with a direction to the respondent to consider the representation or seek clarification from the hands of the petitioner and proceed further in accordance with law.
