THIS CRIMINAL PETITION IS FILED UNDER SECTION 439 OF CR.PC., SEEKING TO ENLARGE THE PETITIONER/ACCUSED ON BAIL WHO IS ARRAYED AND ARRESTED AS ACCUSED IN CRIME NO. 252/2022 OF HONNAVARA POLICE STATION FOR THE ALLEGED OFFENCES PUNISHABLE UNDER SECTION 504, 506 AND 307 OF IPC.

Heard on bail application.

¶20

On the basis of the complaint filed by Narasimha S/o. Venkataraman Shetty, Honnavar police have registered the case in Crime No.252/2022 against the accused for commission of offences punishable under Sections 307, 504 and 506 of IPC. Accused arrested on 02.07.2022 and now still the accused is in judicial custody. After completion of investigation the investigating officer has filed charge sheet against the accused for offences punishable under Sections 307, 504 and 506 of IPC. The subsistence of prosecution case is that on 02.07.2022 at about 12 hours (night time) the accused have assaulted his wife with knife with an intention to committed murder

and caused the grievous injuries on the hands of the injured. The accused also abused his wife Smt.Asha in a filthy language and caused the criminal intimidation to her and thus the accused committed the alleged offence.

The wound certificate reveals that, the injured

Smt. Asha Manjunath Shetty aged 55 years has sustained injuries Multi small laceration measuring between 5 to 3 cms., on both fore-arms. Doctor has opined that, injury is grievous in nature. The accused is not required for further investigation. The accused is in judicial custody since from the date of his arrest i.e., from 02.07.2022 to till this day. Considering the nature and gravity of offences the relationship between the petitioner and the injured it is just and proper to release the accused on bail with conditions. Accordingly, I proceed to pass the following:

The bail application filed under Section 439 of Cr.P.C. is allowed. The petitioner herein shall

be released on bail in connection with Crime No.252/2022, registered by the Honnavara Police Station, if not required in any other case, subject to condition that,

i. The petitioner shall execute a self-bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the Court concerned;

¶30

ii. the petitioner shall not, directly or indirectly, tamper or threaten the prosecution witnesses;

iii. the petitioner shall appear before the Court on all dates of hearing without any fail;

¶32

iv. the petitioner shall not leave the jurisdiction of the concerned court without previous permission of the Court; and

¶33

v. the petitioner shall not commit any offence/s of which he is accused of.
