THIS CIVIL PETITION IS FILED UNDER SECTION 24 OF CODE OF CIVIL PROCEDURE PRAYING TO TRANSFER THE CASE IN M.C.NO.714/2022 PENDING ON THE FILE OF I ADDITIONAL PRINCIPAL FAMILY JUDGE, MYSURU CITY TO III ADDITIONAL FAMILY JUDGE OF BENGALURU CITY AND ETC.

petitioner and Ms.D.Kavitha, learned counsel for respondent.

The present petition is filed by the wife seeking transfer of matrimonial proceedings pending before I Additional Principal Family Court at Mysuru in MC.No.714/2022 to III Additional Judge, Family Court at Bengaluru, to be tried along with C.Misc.600/2022.

Learned counsel for respondent fairly submits that she does not have any objection in the matter being transferred from the Family Court at Mysuru to the Family Court at Bengaluru, as she is interested in the matter being decided expeditiously in the interest of her client i.e. respondenthusband, who has filed a petition for restitution of conjugal rights and custody of minor child.

Under these circumstances, it would not take much time for this Court to decide this matter, as in the interest of the parties, learned counsel have agreed that the matter be transferred to one particular Court to avoid any divergent opinion and to expedite the matter. Accordingly, I pass the following:

i) The petition is allowed ;

ii) The matrimonial proceedings pending on the file of I Additional Principal Judge, Family Court at Mysuru in MC.No.714/2022 and G & WC.No.49/2022 pending before the very same Court is ordered to be transferred to III Additional Judge, Family Court
