UNDER SEC. 31 OF SPECIFIC RELIEF ACT R/W 151 OF CODE OF CIVIL PROCEDURE, AT ANNEXRURE-C OF THE WRIT PETITION AND CANCEL THE INSTRUMENTS VIDE JUDGMENT AND DECREE DATED 11.05.2015 PASSED IN O.S.1629/2012 AND ANNEXURE-B; AND ETC.

Heard the learned counsel appearing for the parties.

In this writ petition, the petitioner has sought for direction to the respondent No.3 to comply with the order dated 03.02.2016 passed by VIII Additional City Civil and Sessions Judge, Bangalore in OS No. 1629 of 2012.

Having taken note of the fact that order passed by

the trial Court in OS No.1629 of 2012, whereby, the trial Court has directed the jurisdictional Sub-Registrar to note with regard to cancellation of the instrument in the Book maintained by him, immediately after the expiry of the statutory period. Thereafter, the petitioner has made representations as per at Annexures-D, E and F requesting respondent No.3 to comply with the order passed by the trial Court in OS No.1629 of 2012.

Having considered the contents of the representations, I am of the view that there is no impediment for the respondent No.3-Jurisdictional Sub-Registrar to consider the representations made by the petitioner herein in accordance with law and convey the outcome to the petitioners forthwith.

Without expressing any opinion on the merits of the case, the writ petition is disposed of directing the respondent No.3 to consider the representations of the petitioner on receipt of certified copy of this order.
