Additional Government Advocate that last date for making application along with the fee for taking examination of SSLC is 29th November, 2022 and considering the interest of the students as a whole, so also, as the petitioner-Institution herein has filed affidavit stating that there are students pursuing their secondary education in the petitioner-Institution, I am of the view that order dated 20th November, 2020 for the present Academic year cannot be made applicable. However, in the event, if the petitioner-Institution does not possess the strength of the students as well as do not have necessary infrastructure to run the institution, it is open for the respondent-Authorities to take suitable action under Section 39 of the Act for the next academic year. In view of the observation made above, the order dated 20th November, 2020 passed by the respondent-Authorities and order dated 08th December, 2021 passed in the Appeal No.2 of 2021 by respondent No.2 are set-aside. It is made clear that the there is no impediment for the respondent-Authorities to take action against the petitioner-Institution, if the petitioner-Institution violates the norms provided under the Act.
