THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT IN THE NATURE OF CERTIORARI OR ANY OTHER APPROPRIATE WRIT OR ORDER QUASHING NOTICE BEARING NO.DGM:KD:NOTICE:2021-22/1271 DATED 01.07.2021 OF THE VIDE ANNEXURE-E AND ETC.

THIS PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY, S.R. KRISHNA KUMAR, J., MADE THE FOLLOWING:

ORDER

In this petition, the petitioner has sought for the following reliefs:

a) Issue a writ in the nature of Certiorari or any other appropriate writ or Order quashing notice bearing No.DGM:KD:Notice:202122/1271 dated 01.07.2021 of the vide Annexure-“E”, in the interest of justice and equity.

b) Issue a writ in the nature of Certiorari or any other appropriate writ or Order quashing endorsement bearing No.MGD:KMD:SQL: 2021-22/1843 dated 09.08.2021 of the vide Annexure-“H”, in the interest of justice and equity.

c) Issue a writ in the nature of Certiorari or any other appropriate writ or Order quashing second notice bearing No.MGD:KMD:NOTICE: 2021-22/2049 dated 25.08.2021 of the vide Annexure-“J”, in the interest of justice and equity.

d) Issue such other relief or reliefs that this Hon’ble Court may deem fit in the

circumstances of the case, in the interest of justice and equity.

Heard learned counsel appearing for the

petitioner, learned Additional Government Advocate

appearing for the respondents and perused the material on record.

Learned Additional Government Advocate on instructions fairly concedes that the impugned order has been passed without affording any opportunity to the petitioner, thereby violating the principles of natural justice and that accordingly, the impugned notice at Annexure-E dated 01.07.2021 as well as the consequent endorsement at Annexure-H dated 09.08.2021 and the second notice dated 25.08.2021 vide Annexure-J are vitiated and deserve to be quashed.

The aforesaid submission of learned Additional Government Advocate is placed on record.

In the result, I pass the following:

I. The petition is hereby allowed .

II. The impugned notice at Annexure-E dated

01.07.2021, the impugned endorsement at

Annexure-H dated 09.08.2021 and the impugned second notice dated 25.08.2021 vide Annexure-J are hereby quashed.
