admitted the receipt of the letter dated 16.07.2004 in terms of Ex.P3. Following this, the plaintiff forwarded a copy of the draft of the release deed to be executed by the defendant No.1, which did not contain any reference to the land bearing Sy.No.15/2 but related only to the land bearing Sy.Nos.9/1, 9/3, 122/1, 122/2, 131/3, 168/2, 170 and 171 of Kolthodu-Bygodu village. It is only thereafter the plaintiff realized that the cattle shed and thrashing yard lay within Sy.No.15/2 and thus, claimed that the said land in Sy.No.15/2 fell to his share. It is relevant to note that according to the plaintiff, the land bearing Sy.No.15/2 measured 2.10 acres. The plaintiff claims that the land bearing Sy.No.15/1 also belonged to the family and was supposedly allotted to the share of the defendant No.2. However, instead of mentioning the survey number as Sy.No.15/1, it was mentioned as Sy.No.15/2. The defendant No.1 did not deny the land bearing Sy.No.15/1 also belonged to the joint family but he contended that the said land was in possession of the defendant No.2.
