Heard the learned counsel appearing for the parties.

Petitioners grievance is that, though the

prosecution has examined CW-1 as PW-1 and CW-2 as PW-2, the said witnesses have not supported the case of the prosecution, but the learned Magistrate has not concluded the trial against the petitioners though there is no material

produced by the prosecution to proceed further against the petitioners. The impugned proceeding is pending since 2013.

Learned counsel appearing for the petitioners submit that the prosecution after examining the witnesses as PW-1 and PW2 have not taken any steps to examine the other witnesses. He further submits that during the pendency of this petition, Doctor and Investing Officer have been examined.

In view of the same, this Criminal Petition is disposed of directing the learned Principal Civil Judge & JMFC, Nelamangala to conclude the proceedings in CC. No.1225/2013 for the offence punishable under Sections 323, 504, 506, 353 r/w 34 of IPC within three (3) months from the date of receipt of certified copy of this Order.
