The petitioners are before this Court calling in question the proceedings in crime No.18/2022 registered for the offences punishable under Sections 447, 504, 506 and 149 of IPC,

pending before the 1^st Additional Civil Judge and JMFC,

Kanakapura.

Brief facts leading to the filing of the present petition, as

borne out from the pleadings, are as follows:

The petitioners and the complainant – respondent No.2 are of the same family and have a dispute between them with regard to the properties that fell to their share, out of a family partition. The petitioners on the ground that there has been constant interference and harassment by the present complainant initially register a complaint on 01.08.2021, against the present complainant for offences punishable under Sections 504, 323, 354, 506 and 34 of the IPC in crime No.132/2021. The police after investigation have filed a charge sheet against the present complainant and the matter is pending in C.C.No.1937/2021. Not stopping at that, the complainant again behaved in a manner that would become punishable under Sections 506, 504, 323, 324, 354 and 34 of the IPC and again a complaint is registered against the present complainant on 24.12.2021,

which is pending investigation in crime No.225/2021. After the registration of the aforesaid cases, the complainant registers a complaint against the petitioners on 29.01.2022, for an incident that is alleged to have occurred on 21.01.2022, for offences punishable under Sections 149, 447, 504 and 506 of IPC, in crime No.18/2022. Registration of this crime drives the petitioners to this Court in the subject petition.

Learned counsel for the petitioners submits that the complaint impugned in the subject petition is registered in crime No.18/2022 as a counter blast, without there being any substance. An incident alleged to have taken place on

21.01.2022, is sought to be agitated on 29.01.2022, without any explanation for delay of 8 days in registering the complaint, more so, in the teeth of the fact that the petitioners have registered two complaints against the complainant, both for the same offences of trespass and assault.

Learned High Court Government Pleader would contend that the matter is still at the stage of investigation and the result is awaited. He submits that the proceedings will be continued, if the petition is dismissed.

I have given my anxious consideration to the submissions made by learned counsel appearing for both the parties and perused the material on record.

The aforesaid facts of the case at hand are not in dispute. The first complaint registered against the present complainant by the petitioners reads as follows:

This complaint becomes crime No.132/2021. The police after investigation have filed a charge sheet and the matter is pending in C.C.No.1937/ 2021. The petitioners do not stop at registration of the aforesaid crime. A second complaint was registered by the petitioners on 24.12.2021, for an incident that happened on the same day, as afore-quoted. The complaint registered on 24.12.2021, reads as follows:-

After registration of the complaints as afore-extracted, the present complainant registers the impugned complaint on 29.01.2022, alleging that the incident of house trespass has happened on 21.01.2022.

Learned counsel for the petitioners also submits that a suit between the parties for injunction is pending adjudication before the competent civil Court in O.S.No.37/2022. In the light of the admitted fact that the parties are before the civil Court exercising their respective rights though the same has been instituted after the registration of the complaint. A perusal of the complaints as quoted supra , it cannot but be said that the registration of the crime is a counter blast to the civil suits so

filed by the petitioners and the matter is purely civil in nature. On a bare perusal at the complaint or even the summary of the charge sheet, none of the ingredients of the offences are satisfied. In the teeth of the aforesaid facts, complaint and the pendency of the proceedings between the parties in the civil Court, if further proceedings are permitted to be continued, it would be an abuse of the process of law and result in miscarriage of justice.
