THIS CCC IS FILED UNDER SECTIONS 11 AND 12 OF THE CONTEMPT OF COURTS ACT, BY THE COMPLAINANT PRAYING TO INITIATE CONTEMPT PROCEEDINGS AGAINST ACCUSED FOR DISOBEYING THE ORDER DATED 27.07.2007 PASSED IN R.P.NO.368/2006 IN W.P.NO.7239/2006 (S-KAT).

The present contempt petition came to be filed by the complainant to take action against the accused/respondents under the provisions of Sections 11 and 12 of the Contempt of Court Act, 1971 for willfully disobeying the order dated 27.07.2007 passed by the Co-ordinate bench of this Court in Review Petition No.368/2006 in W.P.No.7239/2006 (S-KAT), wherein the Co-ordinate bench of this Court allowed the Review Petition by modifying the order dated 29.06.2006 passed in W.P.No.7239/2006 and quashed the order passed by the KAT in O.A.No.285/2001, directing the respondents to consider the claim of the petitioner keeping in view the observations made and dispose of the same within three months from the date of receipt of a copy of the said order.

The State has filed Special Leave to Appeal (Civil) CC No.4613/2008, wherein, the Hon'ble Supreme Court has issued

notice on 04.04.2008. Subsequently, during the pendency of the present contempt petition, the State has also preferred Civil Appeal No.6389/2009, wherein the Hon'ble Supreme Court has dismissed the Civil Appeal by order dated 6.2.2018 holding that the impugned order shall not be treated as a precedent for other cases.

Today, Sri Kiran Kumar, learned Government Advocate filed a Memo along with the revised pensionary benefits in favour of the Complainant dated 22.06.2019. The same is placed on record.
