THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT R-2 TO ALLOT LANDS MEASURING 3 ACRES AND 2 ACRES 19 GUNTAS IN SY.NO.19, SHIVAGANGE VILLAGE, SOPURA VILLAGE, NELAMANGALA TALUK AT ANNEXURE-G AND G1 DATED 18.06.2016.

ORDER

The petitioners are before this Court seeking for the following relief:

"Issue a writ of mandamus or any other appropriate writ or order, directions, directing the 2^nd respondent to allot lands measuring 3 acres and 2 acres 19 guntas in Sy.No.19, Shivagange Village, Sopura Village, Nelamangala Taluk at Annexure-G and G1 dated 18.06.2016."

The contention of the petitioners is that the petitioners are ex-military persons and they have rendered service for the Indian Army for 18 years and as such, the petitioners were eligible for grant of land. The representations dated 18.01.2016 have been made by the petitioners to the respondent No.2, vide Annexures-G and G1, respectively. The contentions of the petitioners are borne out from the documents produced.

In view thereof, a mandamus is issued directing the respondents to consider the said representations made by the petitioners at Annexures-G and G1 within a period of

three months from the date receipt of certified copy of this order. If the lands sought for by the petitioners are not available, the respondents are directed to consider the representations in respect of the similarly situate alternate lands, which could be granted in favour of the petitioners within the aforesaid time.

The respondents will act on a print out of the uploaded copy of this order on the website of this Court, if so furnished by the petitioners, without waiting for certified copy thereof. If the respondents has any doubt about the order, the respondents may verify the contents of the order from the website of this Court and or from the learned Additional Government Advocate.
