Learned Counsel for the petitioners, has stated before this Court that an application was preferred before the Tribunal directing the respondent-State to finalise the provisional seniority list of the cadre of Deputy Director of Statistics and thereafter, consider the cases of Deputy Directors for promotion in accordance with the statutory

provisions. The Tribunal has dismissed the application as premature stating that there is no cause of action.

The learned Counsel, at the outset, has informed that the provisional upgradation list published in respect of the Deputy Director of Statistics has now been finalised on 23.4.2020 and therefore, the writ petition can be disposed of directing the respondent-State to consider the cases of the Deputy Directors for promotion in accordance with the statutory provisions governing the field. He has also argued that the respondent-State is required to hold DPC meeting every year keeping in view the vacancies available in the respective cadres and the DPC has not been held for the reasons best known to the respondent-State.

In the considered opinion of this Court, the respondent-State is certainly required hold the DPC meeting to consider the eligible persons for promotion to the next higher post. Therefore, keeping in view the aforesaid, the present writ petition is disposed of with a direction to respondent-State to hold the DPC meeting in accordance with

the statutory provision and consider the eligible persons for promotion, within four months from today.
