IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE R-1 TO REVISE THE MINIMUM WAGES FOR THE SCHEDULED EMPLOYMENT URBAN LOCAL BODIES (ULBS) AND PANCHAYATH RAJ INSTITUTIONS (PRIS) EXPEDITIOUSLY AND AT ANY EVENT WITHIN A PERIOD OF ONE MONTH AS PER THE PROCEDURE MANDATED IN THE MINIMUM WAGES ACT, 1947 AND ETC.

THIS W.P. COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:-

ORDER

In this petition, the petitioners have sought for the

following reliefs:

"1. Issue a writ of mandamus directing the Respondent No.1 to revise the minimum wages for the scheduled employment "Urban Local Bodies (ULB's) and Panchayath Raj Institutions (PRI's)" expeditiously and at any event within a period of one month as per the procedure mandated in the Minimum Wages Act, 1947.

2. Issue a writ of mandamus directing that the minimum wages so revised for the employment "Urban Local Bodies (ULB's) and Panchayath Raj Institutions (PRI's)" be granted retrospective effect

from 05.08.2021, being the date on which the 5 year statutory period elapsed.

3. Pass any further orders as this Hon'ble Court may deem fit within the facts and circumstances of this case in the interests of justice and equity."

Heard learned counsel for the petitioners, learned counsel for the respondents and perused the material on record.

In addition to reiterating the various contentions urged in the petition and referring to the documents produced by the petitioners, learned counsel for the petitioners has filed a memo along with the draft notification dated 29.11.2021, which has been circulated vide office order dated 06.12.2021.

The said memo and documents produced along with the memo are placed on record.

Accordingly, the petition is disposed of directing the respondents to consider the representations at Annexures-B and C dated 08.04.2021 and 29.05.2021 submitted by the petitioners as expeditiously as possible
