THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO PERMIT THE PETITIONER TO APPEAR AND ARGUE AS PARTY IN PERSON IN HIS ENGINEERING EDUCATION MATTER BEFORE THIS HONBLE COURT.

The Coordinate Bench of this Court in W.P.No.1355/2021 (EDNRES) & connected matters disposed off on 19.05.2021 at paragraph

7 has observed as under:

“7. In consideration whereof, this Court would proceed to hold that the writ petitions filed by the petitioner is a blatant abuse of the process of this Court. There is absolutely no merit in these writ petitions. Therefore while dismissing the writ petitions, it is hereby directed that the petitioner shall be precluded from filing any other writ petition in this regard. The petitioner, no doubt, is required to be saddled with exemplary costs, but payment of costs shall stand deferred. If the petitioner files any other writ petition/ proceedings in this regard, office shall put up a note regarding the directions issued hereby. The petitioner shall be called upon to deposit Rs.1,00,000/-(Rupees one lakh), without which the matter shall not be listed. On such deposit, the costs shall be tendered to the respondent-Viveswaraya Technological University. In hope and trust that the petitioner would realize the futility in knocking at the doors of this Court and

on the contrary, the need to single mindedly concentrate on studies and in acquiring knowledge would ultimately dwell upon the petitioner, these writ petitions stand dismissed.”

The learned Co-ordinate Judge as mentioned above, having found the petitioner apparently a chronic litigant, had asked him to deposit Rs.1,00,000/-(Rupees One lakh) only without which the matter shall not be listed; petitioner-party in person does not dispute that he has not made this payment to the Vishweshwariah Technology University as directed.

Petitioner’s submission is that the requirement of that payment was only in relation to Educational matters and therefore, it is nothing to do with other matters; this is bit difficult to countenance; the petitioner on being questioned as to how many cases he has filed, states that totally 23 cases were filed earlier and with the case at hand the number raises to 24; permitting such chronic litigants to file case after case and entertaining those unworthy cases would virtually rob off the precious time of this Court which otherwise can be utilized for poor and needy litigants who are in a long queue seeking justice.

In the above circumstances, Registry is directed to not to post the matter till after the deposit as mentioned above is made. This deposit shall be made within a period of four weeks, failing which, this writ petition stands rejected on it’s own.
