Tribunal seeking writ of mandamus or direction or order directing respondents 1 and 2 to provide him regular promotion as PDO with effect from 15.06.2018 at par with his juniors i.e. respondents 4 and 5 with all consequential benefits by considering the representation dated 14.06.2018 as per Annexures-A9 and A10. It is the grievance of the petitioner that respondents 4 and 5 who are juniors to him were promoted as PDO denying promotion to the petitioner. The Tribunal having heard the matter and considered the material evidence on record, inasamuch as the Gradation List at Annexure-A7 which has been duly admitted by the petitioner maintained by the Zilla Panchayath on behalf of the Secretary Grade II of Gram Panchayath and that the petitioner has not challenged the same, however, the challenge made by the petitioner is only after his retirement from the service after attaining the age of superannuation on 31.01.2018, has held that, respondent-authorities have rightly rejected the representation submitted by the petitioner by assigning valid reasons for not promoting him to the post of PDO. Being aggrieved by the dismissal of the application, petitioner has preferred this writ petition.
