This R.F.A. is filed under Section 96 of the Code of Civil Procedure, 1908, praying to call for the entire records in O.S.No25656/2012 on the file of the XIII Additional City Civil and sessions Judge, Bangalore (Mayo Hall) and to set aside the impugned judgment and decree dated 03-12-2016 and grant such other cost and relief, which this court deems fit to grant under the circumstance of the case, in the interest of justice and equity.

This R.F.A. coming on for orders, through Physical Hearing/Video Conferencing Hearing, this day, the Court made the following:
O R D E R
Learned counsel for the appellant is physically present and submits that due to non co-operation of the appellant, he could not comply the office objections, as such, he is helpless in proceeding further in this matter.
In view of the above submission and also considering the fact that several and sufficient opportunities even as final and last chance were all granted to the appellant for not less than six times and since the learned counsel for the appellant submits his helplessness in complying the office objections, the appeal stands dismissed for non-compliance of office objections.
