of the material available on record, the Tribunal has rightly awarded an amount of Rs.35,000/- on the head of pain and sufferings; Rs.1,21,000/- on the head of medical expenses and Rs.10,000/- on the head of future medical expenses. Hence, I do not find any reason to interfere with the findings of the Tribunal and appropriate compensation of Rs.35,000/- was awarded since the claimant has suffered D-12 unstable burst fracture and she was an inpatient only for a period of 7 days. However, the Tribunal failed to take note of the educational qualifications and failed to consider Ex.P9-copy of education certificate, Ex.P12Appointment Letter, Ex.P13-Pay Slip and Ex.P14-Leave Certificate for a period of 10 months. Having taken note of the nature of injuries, the claimant also not examined the author of the document - Ex.P13 and Ex.P14 in order to prove that the leave for longer period, she did not attend the office. However, the Tribunal failed to take note of the educational qualification of the claimant, who had done the CA., and also working as Project Manager and the Tribunal ought to have taken the income of Rs.25,000/- per month even though the pay slip has not been
