Mantapa, after performance of marriage, PWs. 1, 2 and 6 removed their golden ornaments and kept them in a vanity bag and subsequently, found them missing the further some mobile phones kept in the vanity bag were also found missing. Later the same were recovered at the instance of the accused and thereby the accused committed offences under Section 380 of the IPC and he has destroyed the vanity bag so as to hide the evidence of theft and thereby committed the offence under Section 201 of IPC. The accused faced the trial by denial of charges read over to him. The prosecution examined 10 witnesses to prove the guilt of the accused and got marked 11 documents and 12 material objects. After completing the evidence by the prosecution, the statement of the accused under Section 313 Cr.P.C. came to be recorded. The case of the accused is one of total denial but he has not led any evidence. Accordingly, the trial Court found the accused guilty and convicted and sentenced him to undergo imprisonment for two years and to pay fine of 2,000/- for the offence under Section 380 of IPC and in default to undergo simple imprisonment for 30 days and further to undergo simple imprisonment for six months for the offence under Section 201 of IPC with fine of 5000/- and in default
