Learned counsel for respondent No.3 submits that
charge sheet is already filed by the respondent police. At this stage quashing of FIR does not survive for consideration. Hence, he prays to dismiss the petition as withdrawn.
Accordingly, the petition is dismissed as withdrawn with liberty to file fresh petition challenging the charge sheet.
In view of dismissal of the main petition, application-I.A No.1/2021 does not survive for
consideration.
