(BY SRI K.S.ABHIJITH, HCGP)
THIS CRIMINAL PETITION IS FILED UNDER SECTION 439 OF CR.P.C PRAYING THIS COURT TO ENLARGE THE PETITIONER ON BAIL IN CR.NO.07/2021 REGISTERED BY HEBBUR POLICE STATION, TUMAKURU FOR THE OFFENCE P/U/S 302 R/W 34 OF IPC AND SECTION 27(1)(3) OF ARMS ACT.
THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R
Learned counsel for the petitioner is absent. No representation. It is noticed that the petition is filed on 02.03.2021. The office objections are not been complied with, insipite of listing the matter several times. The order sheet discloses that on 07.04.2021 a week’s time was granted finally to comply with the office objections. Inspite of that the same was not been complied. I do not find any reason to adjourn the matter. Hence, I am of the opinion that the petitioner is not interested to prosecute the matter. Hence, the petition is dismissed for default i.e., for non-prosecution.
