business and there was difference of opinion between the deceased and accused Nos.3 and 4 in dealing with a site. It appears that the deceased had warned accused Nos.3 and 4 not to interfere in his business and even slapped accused No.3. It is therefore, accused Nos.3 and 4 criminally conspired with accused Nos.1 and 2 to cause death of the deceased. On the date of incident, when the deceased was with C.W.5, accused Nos.3 and 4 went to the spot and started talking to him. In the meantime, accused Nos.1 and 2 came in a two wheeler and suddenly, accused No.2 to 4 caught hold of the deceased and it was accused No.1, who is the petitioner herein stabbed the deceased with a knife on his stomach repeatedly. The postmortem report discloses that the deceased had sustained as many as three injuries on his stomach. As per the opinion, the death was due to penetrative injury sustained to the abdomen.
