SEEKING TO ALLOW THIS PETITION BY QUASHING THE FIR REGISTERED IN CRIME NO.3/2021 IN PD HALLI POLICE STATION, BALLARI DIST., NOW BEING INVESTIGATED BY THE POLICE OF THE CEN AND CRIME POLICE STATION, BALLARI, FOR THE OFFENCES PUNISHABLE UNDER SECTION 420 AND 409 OF THE INDIAN PENAL CODE, PENDING ON THE FILE OF THE IV ADDL. CJ AND JMFC, BALLARI.

The complainant Sri. Manoj Kumar is present. He is respondent No.2 in this petition. His learned counsel Sri. B.C. Jyanayyaswami is also present. The learned counsels for the petitioners Sri. H.S.Chandramouli is present through the video conference and Sri. S.M.Tonne is physically present.

Learned counsel Sri. H.S.Chandramouli submits that since the petitioners are residents of Faridabad and on account of the pandemic corona virus prevailing in the country, it was not possible for them to travel to Dharwad to be physically present before the Court.

Learned counsel on both sides filed a petition under Section 320 r/w 482 of Cr.P.C. seeking permission to compound the offences under Sections 420 and 409 of IPC in Crime No.3/2021 in PD Halli police station, Bellari district, now being investigated by police of the CEN and Crime Police Station, Bellari.

The application is supported by the affidavit of respondent No.2-Manoj Kumar and the petition is signed by learned counsel on both sides. Respondent No.2-Manoj Kumar submits that the matter is settled and compromised and the entire money in dispute has been received by way of settlement. By following the decision in Narinder Singh and Others Vs. State of Punjab and Another (2014) 6 SCC 466 and also in the interest of settlement of the dispute as affirmed by the complainant in his affidavit, I am of the view that it is in the interest of justice that permission is accorded for compounding the offences and accordingly, permission is accorded. Hence, I proceed to pass the following:-

Petition is allowed. Permission is given to the parties to compound the offences punishable under Sections 409 and 420 of IPC and consequently, entire proceedings in Crime No.3/2021 in PD Halli Police station, Bellari district, now being investigated by the CEN police, Crime Police Station, Bellari and pending before the IV Additional Civil Judge and JMFC, Ballari, quashed.
