This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to issue a writ of mandamus or order or direction, in the nature of a writ, to complete the recruitment process of the posts of Dy. Manager (Law) by declaration of list of selected candidates and issuance of appointment letters to selected candidates and etc.,

This Writ Petition coming on for Preliminary Hearing in ‘B’ Group this day, through physical hearing/video conference hearing the Court made the following:-

None appears for the petitioner.

In the instant petition, petitioner has prayed for

the following reliefs:

i) Issue a writ of mandamus or order or direction, in the nature of a writ, to complete the recruitment process of the posts of Deputy Manager (Law) by declaration of list of selected candidates

and issuance of appointment letters to selected candidates;

¶27

ii) Quash the notice of cancellation of advertisement for recruitment to the posts of deputy Manager (Law) (Annexure-E); and such other reliefs.

The petitioner was a candidate for the post of

Deputy Manager (Law) (Annexure-E), the process of recruitment was incomplete. Therefore, he has presented this petition.

The petitioner in his pleadings stated that process of recruitment was cancelled on 30/31-12-2015. If the process of selection is cancelled,

the petitioner is not entitled to seek a writ of mandamus to take up the process of recruitment and complete until and unless the cancellation of process of recruitment is set-aside by the competent forum.

Learned counsel for the respondent pointed out

from Annexure-A under the heading of general condition

para-9, by which, selecting Authority has reserved right to cancel / restrict / enlarge / modify / alter the recruitment. In view of clause (9) of the Annexure –A, the respondent – selecting and appointing authority proceed to cancel the notice for the reasons recorded in the file.

In view of these facts and circumstances, the petitioner has not made out a case so as to issue direction to the respondent to take up the incomplete recruitment process.

Accordingly, the writ petition is dismissed.
