This criminal appeal is filed under Section 378(4) of Cr.P.C. seeking to set aside the judgment and order of acquittal dated 01.07.2015 passed by the I Addl.Civil Judge and JMFC-I Court, Gadag in C.C.No.541/2014 and convict the respondent for the offence punishable under Section 138 of N.I. Act.
This appeal coming on for final hearing, this day, the Court, delivered the following:
JUDGMENT
When the matter is listed before the Court for dictating judgment, learned counsel for respondent has filed memo stating that matter is settled and has produced a letter issued by the appellant-company to this effect. Learned counsel for appellant admits the settlement and submitted that appellant would also file memo with the registry for reporting settlement and for withdrawing the appeal. He is permitted to file memo in the Registry.
