The petitioner has filed a memo and states that
the relief does not survive for consideration.
2. The memo reads as follows:
“The above petition is filed challenging the order dated 14-12-2017 passed by the Prl Family Court, Hubballi in M C No. 4/2016. This Hon’ble Court was please to entertain the above petition by granting interim order subject deposit of 25% amount. As per the direction of this Hon’ble Court petitioner has deposited a sum of Rs 48,000/through D D No. 002280 dated 29-01-2018 before this Hon’ble Court. During the pendency of the above petition, the petitioner and respondent at the intervention of elders have settled their dispute and decided to live together. The Court below by taking note of the joint memo disposed off the petition i.e., M C No.4/2016 by its order dated 08-12-2018. The copy of the order sheet is produced herewith for kind perusal of this Hon’ble Court. In view the same above petition may kindly be dismissed as

having become infractious and the petitioner may kindly be permitted to withdraw the amount deposited before this Hon’ble Court, in the interest of justice and equity.”
