This aspect has not been properly considered and appreciated by the Tribunal. In that light, though the claimant has contended that he was earning Rs.5,000/- per month, in order to substantiate the said fact, he has not produced any documents. In the absence of any such documents, notional income of Rs.4,250/- per month is the yard stick, which used to be taken even in settlement of cases before the Lok Adalat. If that were to be adapted, then the appellant is entitled to an amount of Rs.44,880/(4250x12x11x8%) towards loss of future income. Even taking into consideration the injuries suffered by the appellant and other evidence on record, the appellant might have undergone pain and suffering, loss of amenities and must have incurred some incidental expenses. Keeping in view the above said facts and circumstances, an amount of Rs.30,000/- is awarded towards pain and suffering, Rs.30,000/- is awarded towards loss of amenities.
