HEREIN, the compromise petition by the petitioner and respondent is as under:

By the instant Writ Petition, petitioner sought for quashing the award passed by the Labour Court, Bijapur, in KID No.38/2000.

Both parties have entered into a compromise petition on the following terms and conditions:

The petitioner has agreed to pay a lumpsum amount of Rs.5,50,000/- (Rupees Five Lakhs Fifty-Thousand only) to the Respondent in lieu of the award passed in KID No.38/2000 Dated 21.04.2008 by the Labour Court, Bijapur, including the amount of Gratuity payable to the respondent under Payment of Gratuity Act and any other claims under any other law.

Respondent has received sum of Rs.5,50,000/- (Rupees Five Lakhs FiftyThousand only) by way of Cheque bearing its No. “032324” Dated: 06.10.2015 drawn in favour of Sadashiv P.Yadavannavar on Union Bank of India, Branch: Mudhol in the presence of this Hon’ble Court and he has received this amount in full and final settlement of his claim for re-instatement, 50% back wages, consequential benefits and his claim for payment of Gratuity under Payment of Gratuity Act and he has no other claim whatsoever against the petitioner under any law.

The Respondent has accepted and received a lump sum amount of Rs.5,50,000/(Rupees Five Lakhs Fifty-Thousand only) from the Petitioner in full and final settlement of all his claims under any award or any law from the petitioner and the Respondent has no claims of whatsoever nature against the Petitioner.

The Respondent declares that the Petitioner has been absolved of any and/or all claims whatsoever in nature against the respondent.

Therefore, both parties humbly pray that, this petition be disposed-off in terms of this Compromise Petition.
