This Crl.RP. is filed u/Section 397 r/w. 401 Cr.P.C., praying to set aside the Judgment and Order dt. 20.02.2010 passed by the Addl. S.J. & P.O., FTC-III, Mayo Hall Unit, Bangalore, in Crl. A. No.25041/09 by restoring the Judgment and Order dt. 15.04.2009 passed by the XV Addl. Judge & 23rd ACMM., Mayo Hall Unit, Bangalore in C.C. No.5612/05 and allow the appeal by convicting the respondent for the offence p/u/S. 138 of N.I. Act.
This Crl.RP. coming on for Orders, this day the Court made the following:
ORDER
Since from 07.01.2014, time was granted to
the petitioner to take steps. It was adjourned on 27.01.2014, 17.02.2014, 04.02.2015, 11,02.2015, and 20.02.2015. Today, when the case was called out, there is no representation. It appears that the petitioner and his learned counsel have no interest to prosecute the case. The matter is of the year 2010.
Hence, the petition is dismissed for non-
prosecution, as the steps are not taken.
