respondent. It transpires that the respondent had filed a petition for maintenance under Section 125 of the Code of Criminal Procedure, 1973 (hereinafter referred to as ‘the Cr.P.C.’, for brevity). However, the same was dismissed for nonprosecution. Thereafter, the respondent had filed a complaint for an offence punishable under Section 498-A and other provisions of the Indian Penal Code, 1860 (hereinafter referred to as ‘the IPC’, for brevity). Incidentally, she had also sought for reliefs under the provisions of the Protection of Women From Domestic Violence Act, 2005 (hereinafter referred to as ‘the Domestic Violence Act’, for brevity) and it transpires that the court below had directed the present petitioner to pay a sum of Rs.3,000/- as monthly maintenance to the respondent.
