This Criminal Petition is filed under Section 438 of Cr.P.C., praying to enlarge the petitioner on bail, in the event of his arrest in C.C.No.38/2014 (P.C.No.4/2010), pending before the JMFC at Shahabad, which is registered for the offences punishable under Sections 406, 418, 420 and 427 of IPC.

The learned counsel for the petitioner after

arguing the matter for some time submits that petition may be disposed of granting liberty to the petitioner to voluntarily surrender before the JMFC Court, Shahabad, and apply for regular bail with a direction to the concerned Court to consider and dispose of the bail application on the same day.

The petition stands disposed of granting liberty to

the petitioner to surrender before the JMFC Court,

Shahabad, and apply for regular bail by serving copy of the bail application on the counsel appearing for the complainant five days in advance. In that event, the learned counsel appearing for the complainant shall file objections and address arguments on the day on which the petitioner moves bail application without seeking time and the concerned Court is directed to consider and dispose of the bail application expeditiously preferably on the same on merits and in accordance with law.
