This Crl.P is filed under Section 482
Cr.P.C., pryaying to modify condition No.4,
imposed by the learned Sessions Judge, Bijapur,
in Crl. Misc. No.594/12, dated 15.09.2012,
thereby extending the period to approach the
concerned Court for regular bail byu 10 days, in
C.C. No.112/13 [Almel P.S. Crime No.63/12],
pending on the file of J.M.F.C., Court, Sindagi,
in the interest of justice and equity.

This Crl.P coming on for Admission, this
day the Court made the following:

ORDER

The petitioners were granted anticipatory

bail by the learned Prl. Sessions Judge,
Bijapur, in Crl.Misc. No.594/2012 dated
15.09.2012. Condition No.4 of the said Order
was to the effect that the anticipatory bail
order remain in force for a period of two months

and within which, the petitioners were permitted

to file an application for regular bail. The
petitioners did not approach the Court for
regular bail, within two months and therefore,
they sought for extention of time.

2. Vide Order dated 30.11.2013, the
learned Principal Sessions Judge, Bijapur, has
rejected the request of the petitioners. It is
under these circumstances that the petitioners
have approached this Court for extention of
time.

3. Heard the learned counsel for the
petitioners and also the learned SPP.

4. The 1st petitioner is a lady, aged about
70 years, whereas petitioners 2 and 3 are women
and being relatives of the husband of the
deceased, whereas petitioner No.4 is said to be
physically challenged person.

5. Taking into consideration the aforesaid

circumstances and the grounds on which the

petitioners were not able to approach the
learned Principal Sessions Judge, it appears
just and reasonable to modify the condition and
extend the time.

Consequently, the petition is allowed.
Condition No.4 of the Order in Crl. Misc.
No.594/12 dated 15.09.2012 is modified,
extending the time for 10 [ten] days from the
date of this Order.
