The petitioner is the wife. The

respondent is the husband, who is served and unrepresented. The petitioner has filed a petition under Section 24 of the Code of Civil Procedure seeking to transfer M.C.No.1/2011 pending on the file of the Civil Judge (Sr.Dn.), Challakere, to the Principal Family Court at Bangalore. The said proceedings at Challakere are initiated under Section 13 of the Hindu Marriage Act. The petitioner would contend that she has also initiated proceedings at Bangalore in Crl.Misc.No.1275/2009 under the Domestic Violence Act.

submits that the husband has been attending the proceedings at Bangalore.

The present petition is filed seeking

to transfer the proceedings from Challakere to Bangalore, as stated. Having regard to the fact that the respondent has been attending the proceedings at Bangalore, M.C.No.1/2011 pending on the file of the Civil Judge (Sr.Dn.), Challakere, is withdrawn and be heard by the Family Court at Bangalore.
