Mohan Yadav Vs the State of Jharkhand

The present writ petition has been filed for the following reliefs:“(I) For issuance of appropriate writ in nature of mandamus, commanding upon the respondents specially respondent no.4 i.e the Circle Officer, Simariya, Chatra to issue online rent receipt with respect to khata no. 96, plot no. 96, 89, 51 and 14 area 10.54 acres and khata no.96 plot no.96 area 10.00 acres, which is situated at village Salgi in the name of the petitioners. (II) For issuance of an appropriate writ/order/direction, particularly in the nature of Mandamus, directing the respondents to expeditiously dispose of the petitioner's representation dated 13.11.2025, duly received in the office of the Circle Officer, Simariya, Chatra, wherein the petitioners have repeatedly requested for issuance of online rent receipts. Despite father and mother of the petitioners regular made payment of rent offline since 20102011, the online rent receipt for the aforesaid Khata and Plot numbers has not been issued till date, causing serious prejudice to the petitioners.”

The description of land of the petitioners is as follows:“The land pertaining to Khata No.96, Plot No.96, 89, 51 and 14 area 10.54 acres and Khata No.96, Plot No.96 area 10.00 acres situated at Village Salgi.”

It has been submitted by the learned counsel for the petitioners that the rent receipts have been issued to the petitioners till the year 2011 and since after it

has been denied on the ground that the land in question has not been entered online on the official website of the Jharkhand State.

It has been submitted by the learned counsel for the petitioners that the online entry is not the correct reflection of the official record. Although the online entry has no legal basis, still it has great impact in practical life and further it is a government record.

It is not in dispute that online entry should be correct and true reflection of the official record.

In view of the above discussion, the present writ petition is, hereby, allowed directing the respondents to make online entry of the land in question on the official website of Jharkhand State maintained for the records of land and issue online continuous Khatiyan (Adhikar Abhilekh) for the land in question and also issue rent receipt in the name of petitioners, within six weeks from the date of receipt/ production of copy of this order.

It is made clear that if the aforesaid exercise is not completed within six weeks, the petitioners are entitled for Rs.10,000/- (Ten thousand) as a litigation cost, to be paid by the Deputy Commissioner, Chatra, who will recover the said amount from the erring officials.

The respondent No.2 i.e. The Secretary, Department of Revenue, Registration & Land Reforms, Government of Jharkhand, Ranchi, is held responsible for compliance of the aforesaid order.
