1. Heard learned counsel for the parties.

2. The instant writ application has been preferred by the petitioner praying therein for the following reliefs:

“i. For issuance of an appropriate writ(s), order(s), and direction(s) a writ in the nature of mandamus, commanding upon the respondents to consider, verify and finally decide the claim of the petitioner for grant of Family Pension as the unmarried daughter of Late Jonathan Marandi under Pension Payment Order (PPO) No. S/79786, in accordance with the Family Pension Scheme, 1964, the Bihar Pension Rules, 1950, the Jharkhand Pension Rules, the Bihar Reorganisation Act, 2000, and other applicable statutory provisions;

ii. Reconcile, verify and rectify the discrepancies relating to the name of the deceased Government servant and the deceased family pensioner appearing in the Service Book, Pension Payment Order (PPO), Pension Book, Pension Disburser's Portion, Treasury Records, Bank Records and other departmental records by treating the variations in spelling and nomenclature as relating to the same person after due verification of the original records;

iii. Complete the verification process in coordination with the District Education Superintendent, District Programme officer (Establishment), Principal Accountant General (A&E), Jharkhand, Principal Accountant General (A&E), Bihar and the State Bank of India and thereafter sanction and release Family Pension in favour of the petitioner, if found otherwise eligible under the applicable Pension Rules;

iv. Release all consequential monetary benefits, including arrears of Family Pension and all other consequential statutory benefits admissible to the petitioner from the date of her entitlement in accordance with law.

v. For issuance of a direcțion upon the respondents to pass a reasoned and speaking order on the petitioner's claim within a time frame as may be fixed by this Hon'ble Court and to complete the entire exercise of verification, reconciliation of records, correction of clerical discrepancies and sanction of Family Pension within the period stipulated by this Hon'ble Court, so that the petitioner is not deprived of her valuable statutory rights on account of prolonged administrative delay and interdepartmental correspondence.

vi. For issuance of a direction upon the respondents to pay interest on the delayed payment of Family Pension and arrears, at such rate as

this Hon'ble Court may deem just and proper, from the date the amount became due till the date of actual payment, having regard to the prolonged and unexplained delay attributable solely to the respondents.”

3. Learned counsel for the petitioner submits that the petitioner is fully entitled for the prayer made in the instant writ application, however, the grievance of the petitioner has not been redressed.

Learned counsel for the respondents fairly submits that since no counter affidavit has been filed; as such the petitioners may be directed to approach the concerned respondent by filing a fresh representation, who shall look into the matter so that the grievance of the petitioners can be redressed.

Having regard to the aforesaid submissions and without going into the merits of the case, the instant writ application is hereby disposed of by directing the respondent No. 3 to look into the grievance of the petitioner by treating this writ application as representation and take a decision in the matter in accordance with law and applicable rules and regulations and, if the petitioner is found entitled for the benefits, he shall forward the same to respondent No. 7 within a period of 6 weeks from the date of receipt of copy of this order and thereafter, respondent No.7 shall forward the same to Respondent No.8 within a further period of 2 weeks, and finally Respondent No.8 will make the final payment to the petitioner within a further period of 4 weeks. The petitioner may serve a copy of this writ application along with the relevant documents to the concerned respondent for convenience.
