02/ 15.09.2026 By way of present writ application, the petitioners pray for following

reliefs:

(i) To direct the Respondents to revise the pay-scale of the Petitioners in terms of 7th pay commission recommendation payable with effect from 01.01.2016 and a further direction to release the same with consequential arrears of difference of pay-scale in light of the decision of the Jharkhand State Food and Civil Supply Corporation Limited as contained in memo no. 03/11/2022-2219 dated 25.05.2022 (Annexure- 6).

(ii) To direct the Respondents to release the arrears of salary after revising the pay-scale of the Petitioners in terms of 7th pay commission recommendation payable with effect from 01.01.2016.

(iii) To direct the Respondent Authorities to hold and declare that all the Petitioners are entitled for fixation of their pension as well as other pensionary benefits based on the last pay drawn in accordance with the 7th pay commission recommendation which was payable with effect from 01.01.2016.

(iv) To direct the Respondent Authorities to pay the arrears of pensionary benefits which after the revision of the pay-scale of the Petitioners becomes payable from the date of retirement of each of the Petitioners.

(v) To direct the Respondent Authorities to pay an interest at the rate of 18% per annum on the admissible dues with effect from the date of their actual payment.

2. Learned counsel for the petitioners submits that though the government

has already decided to pay the benefits of 7^th PRC but unfortunately, it is only the decision which is taken but no fruits of the same has been extended to the petitioners. Accordingly, the instant application may be disposed of by directing the concerned respondents to look into the matter and take a decision with regard to prayers made in this writ application

3. Learned counsel for the respondents submits that since no counteraffidavit has been filed on behalf of respondents; as such, the petitioners may be directed to file fresh representation before the concerned respondents so that their grievance can be redressed.

Having regard to the above and after going through the prayers made in this writ application and also Annexure-6, it appears that the respondentState has already taken a decision in the matter; accordingly, the instant writ application is hereby disposed of by directing the Respondent No. 2 to treat this writ application as representation and take a decision with regard to the claim made by the petitioners in accordance with law and applicable rules and regulations, by passing a reasoned and speaking order within a period of 8 weeks from the date of receipt of a copy of this order. It goes without saying that if the decision is taken in favour of the petitioners, necessary consequential order be passed within a period of 2 weeks thereafter.

5. One of the petitioners is directed to serve a copy of this writ application to the concerned respondent so that their grievance can be redressed at the earliest.

6. With the aforesaid observations and directions, the writ petition stands disposed of.
