2. The instant writ application has been preferred by the

petitioner praying therein for the following reliefs:

(A) Rule Nisi for issuance of a writ of Mandamus directing and commanding upon Respondents concerned to immediately and forthwith grant medical leave for the period commencing from 22/09/2023 to 02/10/2024 i.e. for a period of 377 days and to treat this period as an authorised absence from duty and regularised the aforesaid period as he was mentally ill and was under treatment at Central Institute of Psychiatry, Kanke, Ranchi and Medical Fitness Certificate has been issued by C.I.P. Kanke, Ranchi to the Petitioner in respect of mental illness and Petitioner has filed detailed application for such medical leave before the Respondents concerned and subsequent to that to release and pay the entire arrear of salary alongwith admissible allowances for a period of 22.09.2023 to 02.10.2024 i.e. for 377 days and house rent allowances admissible to him for the period mentioned above alongwith interest @ 10% per annum on all the lawful and legal admitted dues till the date of actual payment.

(B) AND To immediately and forthwith Pay and release his terminal benefits such as Privilege leave, Un-availed Casual Leave, Casual Leave, Pension, Gratuity, Unutilised leave encashment, Bonus, Annual Performance Linked Incentive and other lawful and legal admitted dues subsequent to the Petitioner's resignation and acceptance of same and relieving Petitioner from Bank of Baroda Service w.e.f. 06/02/2026 and to pay interest @ 10% per annum on all terminal benefits.

3. Learned counsel for the petitioner submits that though the petitioner is fully entitled for the prayer made in the instant writ application; however, in spite of representation before the concerned respondent, the grievance of the petitioner has not been redressed.

Learned counsel for the respondents fairly submits that since no counter affidavit has been filed; as such, the petitioner may be directed to approach the concerned respondent by filing a fresh representation, who shall look into the matter so that the grievance of the petitioner can be redressed.

Having regard to the aforesaid submissions and without going into the merits of the case, the instant writ application is hereby disposed of by directing the concerned respondent to look into the grievance of the petitioner by treating this writ application as representation and take a decision in the

matter in accordance with law and applicable rules and regulations by passing a reasoned and speaking order within a period of 8 weeks from the date of receipt of copy of this order and communicate the same to the petitioner and if the order is passed in favour of the petitioner, all consequential benefits shall be extended to the petitioner within a further period of 2 weeks. The petitioner shall serve a copy of this writ application along with the relevant documents to the concerned respondent for convenience.
