04 / 06.01.2026 : Heard learned counsel representing the petitioner and learned counsel for the respondents.

2. Claim of the petitioner is in relation to post retiral benefits which she was entitled to after the death of her husband late Kishor Ram who was an employee of the State.

3. The husband of this petitioner was working as Jeep Driver in the Circle Office, Rania. After his death no death benefit was granted to the widow thus this widow approached this Court claiming death-cum-retiral benefit.

4. In the counter affidavit it has been submitted that the admitted payment under three heads have been paid. In paragraph 9 of the counter affidavit it has been stated that the Group Insurance amount of Rs. 95,754/-, GPF amount of Rs. 12,80,123/and Earned Leave amounting to Rs. 7,81,830/- have been paid.

5. It has been submitted by the petitioner that amounts under several other heads are still due and family pension has yet not been finalised.

6. Considering the said submission, I direct the respondents to pay all the death benefits to the petitioner and finalize the

pension within a period of six weeks from today. If the petitioner needs to file any form, online or by physical mode, the same will also be facilitated by the respondents.

7. To ensure smooth payment and filling of all the forms and completion of the formalities, I direct the Circle Officer, Rania to act as Nodal Officer. If any form is to be filled up by this petitioner, the Circle Officer will nominate a particular person who will ensure that all the paraphernalia are completed within the aforesaid time for payment of death benefits to the petitioner.

8. So far as MACP is concerned the petitioner will fill up the necessary form and it will be considered by the respondents and an appropriate order will be passed. If any part of the service has to be regularised the respondents will take decision as per the law and will act accordingly.

9. With the aforesaid observation and direction, this writ petition is disposed of.
