1. Heard learned counsel for the parties.

2. The instant writ application has been preferred by the petitioner praying

therein for the following reliefs:

“i. for issuance of an appropriate writ(s), order(s) or direction (s) particularly a writ in the nature of Mandamus commanding upon the respondents to grant him the benefit of the Pay Scale of Rs.9300-34000/with Grade Pay of Rs 5400/-(Level -9) with effect from 02.05.2019 which has already been fixed by the respondents and verified by the District Pension and Accounts Officer, and also to pay arrear of salary w.e.f 02.05.2019 with penal interest.”

3. The grievance of the petitioner is that though his pay fixation has been approved by Annexure-8, however, the same is not being paid to him. Accordingly he prays that the respondent no.3 may be directed to look into the matter, and do the needful for redressal of grievance of this petitioner.

4. Since no counter-affidavit has been filed, learned counsel for the respondents submits that the instant application may be disposed of by directing the petitioner to approach the respondent no.3.

Having regard to the aforesaid submissions and after going through Annexure-8 which is the pay fixation in Level-9, done by the District Education Officer, Ranchi counter-signed by the Principal and Secretary of the concerned school and also approved by the District Accounts Officer. This Court is surprised to see that why the payment is not being made as per Annexure-8. Accordingly, since counter-affidavit has not been filed, interest of justice would be sufficed by remitting the matter to respondent no.3, who shall treat this writ application as fresh representation and after verification of record, including Annexure-8 to the writ application, shall take an appropriate decision and pass a formal order and communicate the same to the petitioner within a period of 8 weeks from the date of receipt of copy of this order. The petitioner may serve a copy of this writ application along with the relevant documents to the concerned respondent for convenience.

6. It goes without saying that the arrears of the admitted dues shall be paid to the petitioner within a further period of 2 weeks.

7. Accordingly, the instant writ application stands disposed of.

8. Pending I.A., if any, also stands closed.
