1. Heard learned counsel for the parties.

2. The instant writ application has been preferred by the

petitioner praying therein for the following reliefs:

i. For Issuance of apporpriate writ(s)/order(s) direction(s), particularly a writ in the nature of mandamus commanding upon the respondents to consider and grant promotin to the petitioner, from the post of Addl. Secretary to the post of Special Secretary, applying “relaxation of Kalawadhi”, provision as specified in Govt. resolution, dated 24.10.2014 (Annexure-8), of which the petitioner totally qualifies and there is availability of vacancies; ii. For issuance of appropriate writ(s)/order(s)/direction(s), particularly a writ in the nature of mandmus commanding upon the respondents to grant the actual benefit of salary to the promotional post of Addl. Secretary, for the period between 24.06.2025 to 24.05.2026, which has been denied and instead, the salary of Addl. Secretary has been granted to the petitioner, w.e.f. 25.05.2026, when he had given joining to the post of Addl. Secretary, Labour Department”.

3. Learned counsel for the petitioner submits that though the petitioner is fully entitled for the prayer made in the instant writ application; however, in spite of repeated representations the grievance of the petitioner has not been redressed.

Learned counsel for the respondents fairly submits that since no counter affidavit has been filed; as such the petitioner may be directed to approach the concerned respondent by filing a fresh representation, who shall look into the matter so that the grievance of the petitioner can be redressed.

Having regard to the aforesaid submissions and without going into the merits of the case, the instant writ application is hereby disposed of by directing the 2^nd Respondent to look into the grievance of the petitioner by treating this writ application as representation and take a decision in the matter in accordance with law and applicable rules and regulations by passing a reasoned and speaking order.

6. Since the petitioner is going to retire soon, the concerned respondent shall pass an appropriate order within a period of 4 weeks from the date of receipt of copy of this order and communicate the same to the petitioner.

7. The petitioner shall serve a copy of this writ application along with the relevant documents to the concerned respondent for early disposal of his case.

8. Pending I.A., if any, also stands closed.
