1. Mr. Prashant Pallav, learned ASGI appearing for the Union of India, has placed reliance upon an order passed by the Hon’ble Apex Court in Special Leave to Appeal (C) No(s). 20673/2025 dated 13.11.2025, and based upon the observations made therein, it has been submitted that the writ petition may be held to be infructuous, as it has already been held to be infructuous.

2. Mr. Saurav Kumar, learned counsel appearing for the writ petitioner, has submitted that an appropriate order may be passed, keeping in consideration the fact that the matter is pending before the learned Central Administrative Tribunal.

3. Heard learned counsel for the parties and perused the order passed by the Hon’ble Apex Court, which reads as follows:

At the outset, Mr. S.D. Sanjay, learned Additional Solicitor General (ASG) appearing for the petitioners, submits that the matter has become infructuous for the reason that the service of the respondent was contractual in nature and the period has already expired, and another person has been given additional charge of the post in question.

2. However, the said contention is disputed by the learned counsel for the respondent.

3. Be that as it may, since the main matter is pending for consideration before the Central Administrative Tribunal (CAT), the present petition stands disposed of as infructuous.

4. As a consequence, in view of the aforesaid factual position, the impugned order dated 19.12.2024 passed by the High Court, against which the present petition has been filed, has also become infructuous.

5. We clarify that we have not expressed any opinion on the merits of the matter, which shall be decided by the Central Administrative Tribunal (CAT) in accordance with law.

4. In view of the aforesaid order, whereby the matter has been rendered infructuous, the instant writ petition, being W.P.(S) No. 6710 of 2024, has become infructuous and is, accordingly, disposed of.
