1. The instant writ application has been preferred by the

petitioner praying therein for the following reliefs:

“For issuance of an appropriate writ/writs, direction/directions directing the respondents to recognize the service of the petitioner from the date of initial appointment i.e. 5.1.1988 or with effect from the date of selection of the school i.e. 12.2.1985 whichever are later in view of the Rules, Regulations, Circulars, Orders and the report of the Screening Committee and further to grant seniority from the date of initial appointment and to pay the salary at least with effect from the date of initial appointment i.e. 3.12.1988 оr with effect from the date of selection of the school i.e. 12.2.1985 whichever are later in terms of the Govt. letter no. 142 dated 04.02.1989 following the judgment and order pronounced by the Full Bench of the Hon'ble Patna High Court passed in Project Uchcha Vidyalaya Shishak Sangh and other cases reported in 2001) PLJR 287, which has been affirmed by the Apex Court in Civil Appeal No. 6626-75 of 2001 and in view of the Rules, Regulations, Circulars and Letters issued by the State Government time to time in respect of Project School and further in view of the instant order dated 5.9.2018

passed in W.P.(S) No 921/2018 with all consequential benefits for which the petitioner is entitled.”

2. After hearing at length, learned counsel for the petitioner submits that similar issue is pending before the Hon’ble Apex Court in S.L.P. No. 8120 of 2024; wherein the right of the teachers of Project Girls’ School is under consideration; as such, the instant writ application may be disposed of by giving liberty to this petitioner to approach the concerned respondent, if the Hon’ble Apex Court decides the case in favour of the teachers of the Project Girls’ School.

3. Learned counsel for the respondents does not oppose the aforesaid contention.

Having regard to the aforesaid submission of the learned counsel for the petitioner, the instant writ application stands disposed of by clarifying that if the order of the Hon’ble Apex Court will help the case of the petitioner, then he would approach the concerned respondent. The concerned respondent in turn, will look into the order of the Hon’ble Apex Court and verify the records of the petitioner and take a decision with regard to benefits to be given.

5. With the aforesaid observation and direction, the instant writ application stand disposed of. Pending I.A., if any, also stands closed.
