1. Heard the parties.

2. The prayer of the petitioners, in this writ petition, is as

follows:-

“i. For a direction upon the respondent authority to immediately and forthwith release the arrears of 50% of the honorarium which was deducted for the period from 01.01.2023 to till date as the decision pertaining to same has already been taken by the competent authority and the same cannot be withheld without any valid and cogent reason in the name of seeking guidance.

ii. For a direction upon the respondent authorities to strictly implement the resolution passed by the Block Administrative-cum-Disciplinary Authority, Pathalgada in its meeting dated 24.12.2024, which affirmed the petitioners’ right to full honorarium and 4% annual increments.

iii. For a direction upon the respondent authorities to pay appropriate cost and interest for delay on payment of the admitted due of the petitioners.”

3. Learned counsel for the petitioners submit that a

decision has already been taken which can be said to be in favour of these petitioners and other similarly situated persons to release 50% of the salary but the respondents are not executing the same. 4. Learned counsel appearing on behalf of the respondents submits that if the petitioners file a detail representation before the District Superintendent of Education - cum-Additional District Program Officer, Chatra -respondent No.8, the case of the petitioners can be considered and if it is found that the petitioners are entitled for the benefit as per law or as per any decision taken by the Government, the same will be extended to the petitioners.

Considering the submission of the parties, I direct the petitioners to file a fresh representation within four weeks before the District Superintendent of Education -cum-Additional District Program Officer, Chatra -respondent No.8. On receipt of the said representation, the case of the petitioners will be considered within eight weeks.

6. If it is found that the petitioners are entitled for any benefit, the same will be extended to them within two weeks thereafter.

¶46

7. If any part of the claim of the petitioners is rejected, the reasons thereof should be communicated to the petitioners within the aforesaid period.

8. With the aforesaid observations, this writ petition stands disposed of .
