of Case No.30/2008-09 with respect to plot no.656 appertaining to Jamabandi No.78 (area 3 bighas, 16 kathas and 5 dhurs), situated in Mouza Amrapara, PS Amrapara, District Pakur.

Learned counsel for the Respondent no.5 i.e. Panem Coal Mines Limited submits that coal mine has not been allotted to respondent no.5 and the said land acquisition was with

regard to allotment of the said land to respondent no.5. She submits that respondent no.5 is also seeking refund of the amount which has been deposited to the respondent no.4.

Mr. Sharma, the learned Senior counsel appearing for the petitioner submits that the petitioner is still in possession of the land and in view of the further development he seeks permission to withdraw this writ petition.

In view of above and considering that the coal mine has not been allotted to Panem Coal Mines Limited and the dispute is with regard to the coal mine allotment to respondent no.5, it appears that this matter has become infructuous.

In view of above, this writ petition is permitted to be withdrawn and stands disposed of as infructuous.
