The instant writ application has been preferred by the petitioner for

the following reliefs:

“1. That the petitioner by way of instant application most humbly and respectfully prays for issuance of writ(s), direction(s), order(s) of or in the nature of mandamus commanding upon the respondents to pay the monetary benefits of GPF with interest and monetary benefits of unutilized accrued leave with interest to the petitioner as she has superannuated from her service on 30.11.2022 and after lapse of about 3 Years the monetary benefits of GPF and monetary benefits of unutilized accrued leave has not been paid till date though the petitioner is female aged about 70 Years, handicapped and belongs to schedule tribe community is being harassed by the respondent

Be pleased to pass such other order(s) which deem fit and proper for conscionable justice to the petitioner.”

At the outset, learned counsel for the petitioner draws attention of this Court towards the counter-affidavit which has been filed by respondent nos. 2, 3 and 7-RIMS and submits that in paragraph no. 5 it has been categorically stated that necessary documents for payment of GPF has already been sent to the State Government and now the State Government will pay the same shortly. So far as leave encashment is concerned the detail of which has already been sent to the State Government.

For brevity, paragraph nos. 5 and 6 of the counter affidavit dated 06.10.2025 are extracted hereinbelow:

“5. That so far as the payment of the amount of G.P.F is concerned the respondent RIMS has done the needful in this matter. The details of deductions made on account of G.P.F from the salary of the petitioner and credited to her G.P.F A/c No. BHR/BHS/7640 have been sent to the State Government with counter signature for the necessary action at that end. This is likely to be paid to the petitioner shortly.

6. That so far as the payment of the amount of Leave Encashment is concerned the necessary details/information has been furnished to the State Government vide letter no. 1474 dated 10.09.2025 for sanction.”

Relying upon the aforesaid categorical averments, learned counsel

for the petitioner submits that now the State Government should be directed to act upon the grievance of the petitioner.

There is no objection on behalf of the respondents. Learned counsel for the respondent-State simply submits that some time may be granted to them so that the grievance of the petitioner can be redressed.

Having regard to the aforesaid submission and also the specific averments made in paragraph nos. 5 and 6, the instant writ application is hereby disposed of by directing the 3^rd Respondent to look into the matter and disburse the amount with respect to GPF and leave encashment along with statutory interest, if any, as early as possible but in any case, not beyond a period of 8 weeks from the date of receipt/production of this
