1. Heard the parties.

2. The petitioner, in this writ petition, prays for following

relief:-

“(1) For issuance of appropriate writ(s)/ order(s) / direction(s) in the nature of mandamus directing upon the respondents to issue rent receipts in favour of the petitioner after due correction in Register-II in connection with land bearing of Mouza Bhageya, Thana Balumath, old Khata No.42, Old Plot No.47 of area 2.58 Acres, now new Khata No.240 and new Plot No.649 in view of order dated 14.10.2017 passed in Revenue Case No.529/1992 as earlier plot in question has wrongly been registered in the name of State of Bihar.

Any other order/order(s)/direction(s) upon the respondents as your Lordships may deem fit and proper.”

3. It is the grievance of the petitioner that though there is

an order in favour of the petitioner to correct the Register-II but the respondents have not executed the said order and are not receiving the rent and issuing rent receipts to the petitioner.

4. Learned counsel for the petitioner submits that suffice it would be if a direction is given to the respondent No.2, the Deputy Commissioner, Latehar to consider the representation of

the petitioner and pass an appropriate order, giving a direction to the respondents, in view of the final order passed in Revenue Case No.529/1992.

Learned counsel appearing on behalf of the State submits that if the petitioner file a fresh representation before respondent No.2, the Deputy Commissioner, Latehar, the same will be considered and an appropriate order will be passed and if it is seen that the order passed in Revenue Case No.529/1992 has attained finality, the order will be complied with.

6. Considering the said submission, I direct the petitioner to file a fresh representation before respondent No.2, the Deputy Commissioner, Latehar, within two weeks. On receipt of the said representation, the case of the petitioner will be considered within a period of six weeks. If it is found that the petitioner’s claim is genuine, appropriate action will be taken.
