1. Heard the parties.

¶18

2. Learned counsel for the petitioner submits that this writ petition can be disposed of considering the averment made in paragraph Nos.11 & 12 of the counter-affidavit.

In this writ petition, the petitioner being the builder has prayed for a direction upon the authorities to register the rest of the shop / space and other structures on production of sale-deeds along with the appropriate registration and other fees in respect of the shops constructed in the premises of “City Centre” Complex situated at Muhalla Banshilal Chowk, Hazaribag.

4. It was the grievance of the petitioner that the said shops were not been registered.

5. In the counter-affidavit, the State has taken a plea that if a sale-deed along with all the relevant document is submitted, the State will do the needful as per the procedure laid down for registration.

6. It is necessary to quote paragraph Nos.11 & 12 of the counter-affidavit, which reads as follows :-

“ 11 . That is humble stated and submitted that as per the direction of the Hon’ble Court in the matter of Syed Shafiqur Rahman. The Hon’ble Court has directed the answering respondent to act as per the notification dated 19.02.2016 which deals with certain procedure with regard to registration in which at Clause-5 it is specifically indicated that if within 15 days of the presentation of an application before the Circle Officer if certificate is not granted in favour of the respective applicant then it would be deemed that there is no objection to the Circle Officer and as such the District Registrar shall accept that it is deemed consent of the Circle Officer.

12. That it is humbly stated and submitted that the answering respondents are responsible government servant will act as per the law. Further it is stated and submitted that as the deed of sale along with relevant documents are submitted by the petitioner before the answering respondents, they will do the needful following the due procedure as per law in this matter.”

Considering that the stand has been taken by the State, I disposed of this writ petition with a direction that the State Authorities to consider the case of the petitioner once individual deeds are filed for registration along with all the fees and other documents and pass an appropriate order and if the documents are in order and there is no other legal impediment, the respondents will register the sale-deeds in question.
