By filing this writ petition, the petitioner has sought for the following reliefs:-

“ for issuance of a writ in the nature of writ of mandamus commanding the Respondent Circle Officer, Itkhori (Respondent No.6), District Chatra to pass appropriate order for mutation of the land appertaining to Khata No.3, Khewat No. 2/5, total 26 plots area 12.04 acres of village Bela, P.S. Itkhori, District Chatra, in the name petitioner in view of the order dated 14.11.2004 passed by Deputy Commissioner, Chatra in Case No. 5/98-99 rejecting the claim of the private respondents with respect to the aforesaid land and for grant of other consequential relief for which the petitioner is entitled in accordance with law.”

2. Heard learned counsel representing the petitioner and learned counsel representing the respondents.

It is the case of this petitioner that the land in question was purchased by his ancestor Pokhan Ram from one Chhakaudi Singh measuring 12.04 acres through registered sale deed dated 5.9.1957 and he became absolute owner and remained in possession till his life and after his death his son Gulab Ram came in exclusive possession over the land in question and after his death the petitioner being the legal heir of Gulab Ram is in possession over the land in question.

3.1. The father of the petitioner, Gulab Ram filed Mutation Case No. 19/1992-93 before the Circle Officer, Itkhori for mutation

in his favour which was allowed by the Circle Officer, Itkhori vide its order dated 26.9.1994.

3.2. Then, Jagdish Ram (father of O.P. No.7,8,9) filed Appeal No. 26/1998-99 in the Court of Land Reforms Deputy Collector, Chatra against the order passed by the Circle Officer, Itkhori which was allowed vide its order dated 26.11.1998.

3.3. Gulab Ram being aggrieved by the order of the Learned LRDC, Chatra, preferred revision before the Deputy Commissioner, Chatra as Case No.5/98-99 whereby the order passed by the LRDC was set aside on 14.11.2004.

3.4. Then, against the aforesaid order, heirs of Jagdish Ram filed Misc. Revision No. 108/2004 before the Learned Commissioner, North Chhotanagpur, Hazaribag which was rejected by the Learned Commissioner vide its order dated 13.8.2024.

The petitioner filed an application dated 18.12.2024 before the Circle Officer, Itkhori requesting therein for mutation of the land appertaining to Khata No.3, Khewat No. 2/5, total 26 plots area 12.04 acres of village Bela, P.S. Itkhori, District Chatra, in the name of this petitioner in view of the order dated passed by Deputy Commissioner, Chatra in Case No. 5/98-99, but the same is pending before Circle Officer and has not passed any order till date.

4. Learned counsel representing the respondents submits that if the claim of the petitioner is pending before the Circle Officer, the same will be considered as early as possible and if the petitioner is entitled for the relief claimed, the same will be extended to him.

5. In view of the facts of this case, I find that the petitioner

only wants a direction upon the respondent Circle officer, Itkhori to pass appropriate order for mutation of the land in favor of the petitioner in view of the order dated 14/11/2004 passed by Deputy Commissioner, Chatra in Case no. 5/98-99.

Thus, I direct the petitioner to approach the Circle Officer within six weeks for ventilation of his grievance along with order of this court and the documents based on which, the petitioner claims mutation. The Circle officer, Itkhori in turn will consider the claim of the petitioner within eight weeks thereafter, and pass an appropriate order. If, the petitioner is entitled for mutation of his land, the same be carried out within two weeks thereafter. If the application is rejected, the reasoned order will be communicated to the petitioner, so that he can challenge the same before an appropriate Forum.

7. With the aforesaid direction this writ petition is disposed of .
