Rule 97(2) of the Jharkhand Service Code, 2001 (full/proportionate pay on full exoneration or wholly unjustified suspension) does not apply to the petitioners: although the coordinate bench quashed the dismissal and remitted only the quantum of punishment, fresh departmental proceedings were thereafter initiated and the petitioners were found guilty of the charges, so their case falls outside the purview of Rule 97(2).
